This Personal Data Processing Policy (hereinafter referred to as the Policy) applies to all personal data that Noventiq Group of Companies (hereinafter referred to as Noventiq) may receive from a user when users use the Noventiq website – www.noventiqstore.ge_ (hereinafter referred to as the Website), Internet services, services, purchase of goods, participation in advertising and marketing campaigns or promotions and/or other interaction with Noventiq (hereinafter referred to as the Services).

  • automated processing of personal data - processing of personal data using information technologies;
  • provision of personal data - actions aimed at disclosing personal data to a certain person or a certain circle of persons;
  • blocking of personal data - temporary suspension of the processing of personal data
  • destruction of personal data - actions as a result of which it becomes impossible to restore the content of personal data in the information system of personal data and (or) as a result of which material carriers of personal data are destroyed;
  • depersonalization of personal data - actions as a result of which it becomes impossible to determine the ownership of personal data by a specific subject of personal data without the use of additional information or such linking requires disproportionately great effort, expenses and time;
  • information system of personal data - a structured set of personal data contained in databases and information technologies and technical means that ensure their processing;
  • cross-border transfer of personal data - transfer of personal data to the territory of a foreign state to an authority of a foreign state, a foreign individual or a foreign legal entity.

This Policy applies to all processes for collecting, recording, systematizing, accumulating, storing, clarifying (updating, changing), extracting, using, transferring (providing, accessing), blocking, deleting, destroying personal data using automation tools/information technologies.

Noventiq processes personal data in compliance with the principles and rules established by the legislation of Georgia.

Noventiq does not control and is not responsible for the websites of third parties, to which the user can follow the links available on the Noventiq website. Third party websites may have their own privacy policies and other personal data may be collected or requested from the user.

This Policy explains how Noventiq processes and protects users' personal data and other information.

By using the Services and providing Noventiq with the information necessary to initiate further interaction, you agree to its use in accordance with this Policy.

For specific Services, Noventiq may publish additional provisions that supplement this Policy.

The personal data provided to Noventiq by users, are considered unreliable and may be blocked until the user's or his/her legal representative's consent to the processing of the user's personal data is received in any form additionally indicated by Noventiq, in addition to that provided on the Website.

1.3. Noventiq does not make decisions that give rise to legal consequences for users or otherwise affect their rights and legitimate interests based solely on automated processing of personal data.

  1. Purpose of processing personal data of users

2.1. Noventiq processes only those personal data that are necessary to provide and improve the quality of the Services.

2.2. Noventiq may use the user's personal data to achieve the following goal: to fulfill Noventiq 's obligations under orders, contracts and other obligations accepted by Noventiq as binding on the user. Within the framework of this goal, Noventiq implements a set of actions aimed at accomplishing the following tasks:

2.2.12. Implementation and / or execution of functions, powers and duties assigned by the legislation of Georgia to Noventiq.

  • Data processing is necessary for Noventiq’s legitimate interests (except the cases when there is an overriding interest in protecting the rights and freedoms of the data subject
  1. Transfer of personal data of the user to third parties

4.1. With respect to the user's personal data, confidentiality is maintained, except for the processing of personal data, access to which is granted to an unlimited number of persons by the user, or at his request.

4.2. Noventiq has the right to transfer the user's personal data to third parties in the following cases:

4.2.1. The user has provided his consent to such actions, including for the purpose of registering the software in the user's name by copyright holders, distributors or resellers of the software, and delivering the goods.

4.2.2. The transfer is necessary to achieve the goal, exercise and fulfill the functions, powers and duties assigned by the legislation of Georgia to Noventiq.

4.3. In order to fulfill obligations under orders, contracts and other obligations to the user, Noventiq may carry out cross-border transfer of personal data on the territory of foreign states, to foreign state or international organization, if appropriate data protection guarantees are provided in the relevant state or international organization.

4.4. Types of data transfer and their recipients: organizations processing data on behalf of Noventiq (for the purposes of technical, marketing and software support), if necessary, independent third parties (auditors, lawyers, regulatory authorities) or recipients to whom data transfer is based on actions and decisions taken by the user (for example, in cases where the user has chosen delivery to his address with the involvement of a third party).

  1. Measures applied to protect the personal data of users

5.1. To ensure the fulfillment of the obligations stipulated by the legislation of Georgia and the regulatory legal acts adopted in accordance with it, Noventiq has taken the following measures to protect the personal data of users:

5.1.1. The person responsible for organizing the processing of personal data has been appointed.

5.1.2. Local acts have been issued on the processing and security of personal data, as well as local acts establishing procedures aimed at preventing and detecting violations of the legislation of Georgia, and eliminating the consequences of such violations.

5.1.3. Legal, organizational and technical measures have been taken to ensure the security of personal data.

5.1.4. The rules for access to personal data processed in personal data information systems have been established.

5.1.5. Registration and accounting of all actions performed with personal data in personal data information systems is carried out.

5.1.6. Rules for backing up and restoring information and personal data have been established.

  1. Rights and obligations of the user

6.1. Noventiq takes reasonable measures to maintain the accuracy and relevance of the personal data held by Noventiq, as well as to delete outdated and other inaccurate or redundant personal data. However, the User is responsible for providing accurate information, as well as for updating the provided data in case of any changes.

6.2. The user may at any time change (update, supplement) the personal data provided by him or part of it, as well as their confidentiality settings by contacting Noventiq.

6.3. The user has the right to withdraw consent to the processing of personal data by Noventiq at any time by sending a written notice to the address: 13 G.Danelia str. 0186 Tbilisi, Georgia  marked "withdrawal of consent to the processing of personal data", while the withdrawal of consent by the user to the processing of personal data may possibly entail deleting the user's account from the Web website, as well as the destruction of records containing personal data in Noventiq's personal data processing systems, which may make it impossible to use Noventiq's Internet services .

6.4. The user has the right to request the correction, update, addition, blocking, deletion and destruction of his personal data if the personal data is incomplete, outdated, inaccurate, illegally obtained or not necessary for the stated purpose of processing.

6.5. The user has the right to receive information regarding the processing of his personal data in Noventiq, for which he has the right to send a written request to the address: 13 G.Danelia str. 0186 Tbilisi, Georgia marked "request for information on the procedure for processing personal data".

6.6. The right to withdraw consent: the user has the opportunity to terminate the subscription to Noventiq marketing communications at any time by clicking on the appropriate link present in all Noventiq marketing communications, the user has the opportunity to change their cookie settings or contact Noventiq in accordance with the contact information provided in Section 7 of this Policy.

6.7. To comply with the provisions in clauses 6.2, 6.3, 6.4, 6.5 and 6.6 of this Policy, Noventiq may require confirmation of the user's identity by requesting the provision of such confirmation in any form that does not contradict the law. Noventiq undertakes to consider and send a response to the received request within 30 (thirty) days from the date of receipt of the request.

6.8. Users' personal data will not be stored or processed by Noventiq upon reaching the period required to achieve the purposes of processing and upon completion of the data storage period. Noventiq will stop processing and destroy the personal data of users within the time limits specified in Section 8 of this Policy upon achieving the goals of processing this data, unless otherwise provided by the current legislation of Georgia.
